Statutory compensation

Fee calculators for estates

For decedents' estates in California, Florida, New York and Texas, Summafolio computes the statutory compensation and shows the tiers. Examples on a simple base (no adjustments):

Example statutory compensation
BaseCalifornia PR (Prob. Code §10800)Florida PR (Fla. Stat. §733.617)New York executor (SCPA §2307)
$500,000.00$13,000.00$15,000.00$19,000.00
$1,000,000.00$23,000.00$30,000.00$34,000.00
$2,000,000.00$33,000.00$55,000.00$59,000.00

Each state defines the base differently (California: inventory plus gains, minus losses, plus receipts; Florida: inventory plus income earned; New York: property received and paid out, excluding specific bequests). Texas executors receive 5% of cash received and 5% of cash paid, capped at 5% of the estate's gross fair market value (Tex. Est. Code §352.002). Courts can allow extraordinary compensation, and wills can set different terms. Trustee compensation follows the trust instrument or a reasonableness standard and isn't computed.
